In an effort to keep you appraised of where we are at in this round of bargaining, enclosed you will find copies of three letters.
The first letter dated December 29, 1999, from National Carriers Conference Committee Chairman Robert F. Allen, wherein Mr. Allen agreed to move forward in this round of bargaining in the dual tack method as was done in the last round of bargaining. But in order to do so, Mr. Allen requested that the International Division be granted authority from the General Committees to negotiate in their behalf on issues that have been agreed to be discussed nationally, i.e., rates of pay, health and welfare, vacation and holiday pay.
The second letter dated January 7, 2000, from International President Edward Dubroski in which he requests our authorization as had been committed by the parties to Mr. Allen. This commitment was an effort to convince the NCCC that carrier specific issues needed to be addressed on individual properties and to get them moved off their position that all issues were national in scope. In so doing, the court case initiated by the NCCC over this issue is negated.
The third letter dated January 14, 2000, signed by all BLE/BNSF General Chairmen granted authority to the International Division to negotiate in our behalf on specific issues addressed in our joint Section 6 Notices.
Meetings were held with the BNSF on January 11th and 12th in an effort to determine which Section 6 Items would be handled nationally and which issues would remain on property for resolution. The next meeting with BNSF will be on February 15th and l6th.
This office will keep you appraised as we move down this road to a new contact.

This refers to our earlier discussions during which I offered to put in writing a proposal we discussed that would permit us to begin negotiations for a collective bargaining agreement without prejudice to each other’s positions.
The proposal is as follows:
The authorized BLE representative(s) on each carrier represented by the NCCC will meet on a local basis with appropriate carrier officers and identify those issues that may be addressed locally. Such subjects may include, for example, proposals that have been previously bargained locally on that particular carrier or arc covered by outstanding local Section 6 notices served on that property. Subjects that may not be included for local bargaining are matters that are to be Handled on a national basis. Any disputes as to what may or may not be handled locally shall be resolved by your office and the NCCC. This agreement is not intended to affect the manner of handling claims and grievances. Once agreement is reached, the authorized BLE representative may then initiate conferences locally on those subjects that the parties have agreed could be handled locally. Where such conferences were initiated, the carrier could respond with similar notices. If the BLE. representative chooses not to initiate such discussions, then no such discussions would occur,
Negotiations concerning issues that are common to all carriers would occur between representatives of the BLE and the NCCC simultaneously. However, negotiations with respect to the common issues cannot be successfully concluded until all negotiations with the carriers on an individual basis are concluded, unless a particular carrier or organization representative involved may otherwise agree. And, finally, in the event that negotiations are unsuccessful on the common issues and mediation is invoked, the entire dispute

Dear Sirs and Brothers:
Enclosed is a copy of the December 29, 1999, letter from the Chairman of the National Railway Labor Conference, Robert F. Allen, in which he sets forth the National Carrier Conference Committee agreement to meet on a local basis to address local issues, i.e., dual track bargaining. Insofar as Mr. Allen has honored
his commitment regarding dual track bargaining, it is now time for us to honor our commitment to the National Carrier Conference Committee to obtain authorization from each of you to represent you in the upcoming round of negotiations as it pertains to attachment A and B.To this extent, I am requesting that each of you fax me a copy of your authorizations, no later than Friday, January 14th so when I meet with the NCCC during the week of January 17th I will be able to apprise them of the fact that I am speaking on your behalf. It should also be noted, that once I receive your authorizations, the National Railway Labor Conference will then join with me in getting the lawsuit currently pending in the DC district court dismissed.

The General Committees of Adjustment, Brotherhood of Locomotive Engineers, having jurisdiction on the Burlington Northern and Santa Fe Railway Company, hereby authorize the International President, Brotherhood of Locomotive Engineers and/or his designated representative(s) to speak and act on behalf of the employees of the above-named carrier represented by the Brotherhood of Locomotive Engineers in the further handling of disputes arising out of certain Section 6 Notices of these Committees and the above-named carrier. This authority is coextensive with Section 6 Notices and Proposals listed below:
