This is a step in the right direction. Granted, extra board employees are not included yet, but the GCA is still trying to get them added to this. This goes a long way toward showing regulatory agencies the carrier is not interested in allowing all employees the opportunity for equal rest, but are simply showing lip service to work/rest/fatigue issues.


 

AGREEMENT

between

THE BURLINGTON NORTHERN AND SANTA FE RAILWAY COMPANY

and

THE BROTHERHOOD OF LOCOMOTIVE ENGINEERS

 

The purpose of this trial agreement is to further BNSF's work/rest efforts by providing a minimum period of undisturbed rest to locomotive engineers in unassigned pool freight service at their home terminals.

IT IS AGREED:

 

1. Locomotive engineers in unassigned pool freight service wilI not be called for service at their home terminals prior to receiving eight (8) hours undisturbed rest. For purposes of this Agreement "undisturbed rest" means that The Carrier (typically Crew Support) will not contact engineers to inform them of their on-duty time until the engineer has had eight (8) consecutive hours off, measured from the last off-duty time.

2. Pool engineers who have not had eight (8) consecutive hours of undisturbed rest at their home terminals are not eligible to be called to work.

3. Any engineer who is erroneously called prior to the expiration of eight hours undisturbed rest will not be entitled to any claim or penalty for such error, but may refuse the call.

4. Each pool engineer subject to this agreement may be run around without penalty by following engineers during the former’s period of undisturbed rest.

5, This Agreement modifies existing agreements only to the extent set forth in this Agreement and all other schedule rules and agreements remain in effect.

6. This Agreement may be cancelled by either party upon five (5) days’ written notice on the other party after sixty (60) days from its effective date.

Dear Mr. Geiger:

This letter confirms our discussion concerning the process by which individual unassigned freight pools may be added to or removed from the list of pools covered by the Agreement dated July 14,2000, which provides that certain employees in unassigned pool freight service will not be called for service at their home terminals prior to receiving eight (8) hours undisturbed rest.

If the appropriate general chairman is party to the agreement dated July 14,2000, that general chairman may make a written request to Labor Relations that a specific unassigned freight pool may be covered by the agreement which provides that certain employees in unassigned pool freight service will not be called for service at their home terminal prior to receiving eight (8) hours undisturbed rest. Upon receipt of the written request the request will be reviewed by the appropriate assistant vice president -Transportation, and Labor Relations will contain the effective date upon which the Agreement will take effect.

To eliminate a specific unassigned freight pool from coverage of the July 14,2000 Agreement, the appropriate general chairman or the appropriate management representative may serve a five day written notice on the other party, and upon expiration of the five days, the specific unassigned freight pool identified in the cancellation notice will no longer be covered.

This application of this letter is limited to the addition or elimination of specific unassigned pools and in no way limits the right of’ either party to cancel the agreement dated July 14 upon five (5) days’ written notice, after sixty (60) days after the effective date.
