This assigned car agreement is a last ditch effort to save 13 regular assignments. After several days of negotiation, sitting across the table from people who only know how to say NO, this is the proposal presented that may or may not allow us to keep the 13 regular assignments under the ID agreement. Give and take have been made, and whether or not we keep this agreement will rest with the members of Division 758. These jobs will be abolished and re-established on 03-16-04 with the changes mentioned below. At that time, a test period will ensue, and then the members of Div. 758 will be asked to vote on whether or not to keep the assignments. If the decision to cancel is made, then the ID pool will revert back to Section 3 of Ops 16-85 (Vancouver-Pasco ID Agreement) that will require 4 regular assigned engineers to be inserted into the pool at 05:15 AM, and 4 regular assigned engineers to be inserted into the pool at 5:15 Pm each and every day. This will require  3 sets of am and 3 sets of pm assigned engineers. All trains will then go into the pool. Feedback is requested from each member.

AGREEMENT  

Between  

THE BURLINGTON NORTHERN AND SANTA FE RAILWAY COMPANY  

And  

THE BROTHERHOOD OF LOCOMOTIVE ENGINEERS AND TRAINMEN

 

 

This Agreement is to modify existing assignments headquartered at Vancouver , Washington .

 

IT IS AGREED:

 

1.                  On the effective date of this Agreement, three engineer’s assignments (currently E1-VAW6101 VAW6102, VAW6103, previously #02) will be bulletined and established to protect service between Vancouver and Pasco as described herein:  

a.       These assigned crews will have an established four hour call window at Vancouver from 12:30 am until 4:30 am.  The Carrier may adjust the start time of the four hour call window with 48 hours notice to the assigned crews.

b.      The assigned crews will stand for service at Vancouver within this window on train Z-PTLCHC or deadhead to Pasco . (Monday-any train in the window)

c.       Upon arrival at Pasco , these assigned crews will stand for service on M-PASLYD or deadhead home.

 

2.                  On the effective date of this Agreement, three engineer’s assignments (currently E-2-VAW6201, VAW6202, VAW6203, previously 620) will be bulletined and established to protect service between Vancouver and Pasco as described herein:  

a.       These assigned crews will have an established five hour call window at Vancouver from 11:00 pm until 4:00 am.  The Carrier may adjust the start time of the five hour call window with 48 hours notice to the assigned crews.

b.      The assigned crews will stand for service at Vancouver within this window on any train in the window or deadhead to Pasco

c.       Upon arrival at Pasco , these assigned crews will stand for service on M-PASVAW or deadhead home.

 

3.                  On the effective date of this Agreement, three engineer’s assignments (currently E-3-VAW6301, VAW6302, VAW6303, previously 664) will be bulletined and established to protect service between Vancouver and Pasco as described herein:  

a.       These assigned crews will have an established four hour call window at Vancouver from 1:00 pm until 5:00 pm.  The Carrier may adjust the start time of the four hour call window with 48 hours notice to the assigned crews.

b.      The assigned crews will stand for service at Vancouver within this window on  the M-PTLPAS or deadhead to Pasco .

c.       Upon arrival at Pasco , these assigned crews will notify the terminal trainmaster of their rest time and they will be profiled for the train arriving closest to their rest or deadhead home.

 

4.                  On the effective date of this Agreement, two engineer’s assignments (currently E4-VAW6401, VAW6402, previously 675) will be bulletined and established to protect service between Vancouver and Pasco as described herein:  

a.       These assigned crews will have an established eight hour call window at Vancouver , Tuesday through Saturday, from 11:00 pm until 7:00 am.  The Carrier may adjust the start time of the eight hour call window with 48 hours notice to the assigned crews.

b.      The assigned crews will stand for service at Vancouver within this window on a Garbage Train, or deadhead to Pasco .

c.       Upon arrival at Pasco , these assigned crews will stand for service on a Garbage Train originating at Roosevelt WA , or deadhead home

 

5.                  On the effective date of this Agreement, one engineer’s assignments (currently E5-VAW6501, previously 681) will be bulletined and established to protect service between Vancouver and Wishram as described herein:  

a.       This assigned crew will have an established six hour call window at Vancouver Tuesday through Saturday from 12:30 pm until 6:30 pm.  The Carrier may adjust the start time of the six hour call window with 48 hours notice to the assigned crews.

b.      The assigned crews will stand for service at Vancouver within this window on the H-EVEBAR, or any train destined to the Oregon trunk or deadhead to Wishram.

c.       Upon arrival at Wishram, this assigned crew will stand for service (without taking rest) back to Vancouver on any train at or between Wishram and Vancouver or deadhead home.

 

6.                  On the effective date of this Agreement, one engineer’s assignment (currently E6-VAW6731, previously 673) will be bulletined and established to protect service between Vancouver and Wishram as described herein:  

a.       This assigned crew will have an established eight hour call window at Vancouver , Tuesday through Saturday, from 4:59 am until 12:59 pm.  The Carrier may adjust the start time of the eight hour call window with 48 hours notice to the assigned crews.

b.      The assigned crews will stand for service at Vancouver within this window on a Garbage Train, or deadhead to Wishram.

c.       Upon arrival at Wishram, this assigned crew will stand for service on any train, or deadhead home.  This assigned crew may be called on duty at Wishram following a four hour release. 

 

7.         Crews assigned under this agreement who are not called at Vancouver to work or deadhead within their call windows will paid the round trip as though worked and will stand for future service in their normal assignment rotation.  Assigned crews called to deadhead at Vancouver will be so advised in the calling window, although their deadhead departure time may be outside the window.  Assigned crews called to deadhead will be paid the mileage of the assignment.  Payment will be allowed for overtime after twelve hours on duty on interdivisional assignments.  Held away from home terminal payments will commence after 16 hours at the away from home terminal.

 

8.         This is a local arrangement.  It will not be referred to by either party under any circumstances in any other cases nor utilized to progress claims beyond the local level

 

9.         This Agreement only modifies existing agreements to the extent set forth, and all other schedule rules agreements and/or other rights remain in effect.  In the event of cancellation of this local agreement, any modifications herein would cease. 

 

10.       Either party serving ten days’ written notice on the other party may cancel this Agreement.  Prior to serving a cancellation notice, however, local management and/or the local chairman signatory will request a meeting to attempt resolution.
